By creating an account or using Caustic Studio, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will update the "Last updated" date at the top of this page when changes are made.

You must provide accurate information when creating your account, including a valid email address.

You are responsible for maintaining the security of your account credentials. Do not share your password with others. Enable two-factor authentication for additional security.

You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.

You must be at least 13 years old to create an account and use the Service.

You agree not to use the Service to: upload, publish, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

You agree not to: attempt to gain unauthorized access to other accounts, systems, or networks connected to the Service.

You agree not to: use the Service to distribute malware, spam, or phishing content.

You agree not to: interfere with or disrupt the Service or servers, including through denial-of-service attacks, automated scraping beyond reasonable use, or exploiting vulnerabilities.

You agree not to: impersonate any person or entity, or falsely claim an affiliation with any person or entity.

You agree not to: use the Service in any manner that violates applicable laws or regulations.

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.

Your Content: You retain full ownership of all content you create, upload, or publish through the Service, including game projects, assets, devlogs, comments, and any other user-generated content.

License to Us: By uploading content to the Service, you grant Caustic Studio a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your content solely for the purpose of operating and providing the Service. This license ends when you delete the content or your account.

Marketplace Content: If you list content for sale on the Caustic Studio marketplace, you grant buyers a license to use that content as described in the listing. You represent that you have the necessary rights to sell or distribute any content you list.

Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

Subscriptions: Paid plans are billed in advance on a recurring basis (monthly or annually). You authorize Stripe, our payment processor, to charge your payment method for the applicable fees.

Marketplace Transactions: When you purchase assets or games on the marketplace, payment is processed through Stripe. Creators receive payouts according to the applicable revenue split, minus platform fees and Stripe processing fees.

Refunds: Subscription refunds are handled on a case-by-case basis. Contact [email protected] within 14 days of a charge for refund requests. Marketplace purchases may be subject to the individual seller's refund policy.

Price Changes: We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.

Failed Payments: If a payment fails, we will notify you and may restrict access to paid features until the payment issue is resolved. Accounts with overdue payments may be downgraded to the free tier.

The Service itself, including the Caustic Studio application, website, branding, documentation, and underlying technology, is owned by Caustic Studio and protected by intellectual property laws.

The Caustic Studio name, logo, and related marks are trademarks of Caustic Studio. You may not use them without prior written permission.

If you believe content on the Service infringes your intellectual property rights, contact us at [email protected] with details of the alleged infringement.

By You: You may delete your account at any time from your account settings. Upon deletion, all your data is permanently removed. Active subscriptions will be cancelled, and no further charges will be made.

By Us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. Where possible, we will provide notice before termination and an opportunity to export your data.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including limitation of liability, indemnification, and governing law) will continue in effect.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that any defects will be corrected or that the Service is free of viruses or other harmful components.

You use the Service at your own risk. You are solely responsible for any damage to your computer system or loss of data that results from use of the Service.

To the maximum extent permitted by law, Caustic Studio and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You agree to indemnify and hold harmless Caustic Studio from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your content, or (d) your violation of any rights of another party.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Caustic Studio regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
