DMCA & Copyright Policy

This policy describes how Caustic Studio handles claims of copyright infringement on the platform in accordance with the Digital Millennium Copyright Act (DMCA).
1. Overview
Caustic Studio respects the intellectual property rights of others and expects users of the platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the Service.
If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement and is accessible on the Caustic Studio platform, please follow the procedure below to submit a notification.

We aim to respond to all valid DMCA notices within 2 business days.
3. Filing a DMCA Takedown Notice
To file a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your notification must include all of the following:
1. A physical or electronic signature of the copyright owner, or a person authorized to act on behalf of the copyright owner.
2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the platform (e.g., a direct URL to the asset listing, project, or content in question).
4. Your contact information, including your name, mailing address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Please note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
4. Actions Upon Receipt of a Valid Notice
Upon receipt of a valid DMCA takedown notice, we will:
1. Remove or disable access to the allegedly infringing material promptly.
2. Notify the user who posted the material that it has been removed or disabled, along with a copy of the takedown notice.
3. Provide the affected user with information about how to file a counter-notification if they believe the material was removed in error.
5. Counter-Notification
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification. Your counter-notification must include:
1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location at which the material appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Caustic Studio may be found), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the removed material.
6. Repeat Infringer Policy
Caustic Studio maintains a policy of terminating the accounts of users who are repeat infringers of copyright, in appropriate circumstances.
A user will be considered a repeat infringer if they have been the subject of more than two valid DMCA takedown notices within any 12-month period. Upon a third valid notice, the user's account may be permanently terminated without prior warning.
We may also terminate accounts after a single instance of particularly egregious infringement, such as uploading large volumes of clearly copyrighted material for commercial distribution.
7. Good Faith and Fair Use
Before filing a DMCA notice, please consider whether the use of the copyrighted material may constitute fair use under 17 U.S.C. § 107. Fair use considerations include the purpose and character of the use, the nature of the copyrighted work, the amount used, and the effect on the market for the original work.
Game assets, tutorials, fan art, and commentary may qualify as fair use in certain circumstances. We encourage copyright holders to consider these factors before submitting a takedown notice.
